Getting Screwed Over ...

Hey guys ... hope all is well with you. Looking at the blog title and wondering why I am getting screwed? Well, today I received a letter from my previous landlord stating that I would not receive my security deposit as I thought I would. The lease stated only that I would receive it 21 days after lease. That is all it said and the landlord did not say I would not get it back. Well the letter showed deductions/charges for things on the apt. since the move and then a total at the bottom. At first I thought this was the amount that was left after the deductions. Nope! This was an amount that they said I still owed them! Even after given the notice they needed, which was 30 days, and then the following months rent and another month on top of that plus an added amount for a concession on renewing the lease. Well, I was livid. I called up the landlord and brought this up, well, she responded that by breaking the lease, I forfeit my deposit. I was NEVER told this. She said it was on page 2 of the lease ... it isn't! So now I am going to fight this to get the money I am owed. I will probably never see it but I have to fight for it. She never told me this at the time the plans were made. And using the terms "break the lease" makes it sound like I just upped and moved w/o warning and shafted them the amount. This is so not the truth. Anyway ... just wanted to share and explain why the title of the post. Hope all is well with you all and that your week is going great.

please do pursue your rent deposit claim vigouriously and energetically.

they have your money and its their's to sit on till you get it back. perhaps hoping you'd lose interest in it.

write to the landlady and ensure she cannot claim you didn't send her any correspondence.

When you break a lease you forfeit your deposit. That is a fact that is known to just about everyone who ever rented an apartment. So you can cry about your money all day and night, but it's your own fault. Seems like most of your troubles are self-inflicted.

Breaking a lease means moving before the term of your lease is up. It's not rocket science.

Did you live in your place for over a year? If you decided to move before the year lease was completed, then you would be breaking the lease regardless of if you gave 30 days notice or not. That's pretty much a standard. Most leases are for one year and then go month to month after that.

Landlords/agents can be such arseholes but make sure you stick to your guns.
